More than 143 million American workers are protected by the Fair Labor Standards Act (FLSA), the federal law that establishes minimum wage, overtime pay, recordkeeping, and youth employment standards. Under the FLSA covered nonexempt workers are entitled to a minimum wage of not less than $7.25 for all hours worked and overtime pay at a rate not less than one and one-half times the regular rate of pay is required after 40 hours of work in a workweek.In 2023 the US DOL's Wage and Hour Division recovered over $10.3 million in back wages for workers in the health care industry. In order to help employers stay in compliance with the FLSA, this presentation will provide an overview of the law, with a focus on common compliance issues found in the care industry. Using real world examples, we will explore a variety of topics, including determining employment relationships, calculating hours worked under, how to compute overtime pay, and recordkeeping requirements.

Danielle Calderon is the Community Outreach and Resource Planning Specialist (CORPS) for the Wage & Hour Division’s Ohio District Office. Danielle began her career in 2011 as a Wage Hour Investigator. Over the last decade she has acted as a subject matter expert on the laws enforced by the Wage & Hour Division, including: the Fair Labor Standards Act, the Family Medical Leave Act, and the Davis Bacon and Related Acts. Danielle began working as the CORPS for the Ohio in 2022 and works to provide outreach and education to stakeholders throughout the state.
